Divorce and Widowhood in Jordan




Divorce

The divorce is different for woman and man.

For the Woman

If she is filling for divorce because of wrong doing of the husband, she should prove it. So, she can receive the divorce and the amount agreed in the marriage contract for divorce (that normally is higher than the marriage amount).  

If she seeks divorce just based on what she feels and dislikes, without proofs, she should return the payment made by the husband for the marriage (wrote in the marriage contract) by depositing in the court.



For the Man

To divorce his wife, the husband just need to make the petition and pay her the agreed amount for divorce in instalments. 


If the wrong doing was from the wife she should return to the husband, the payment she received for marriage.



After the Divorce

The women will return to her parents' house. 
Divorced or widow women should always return to live with their families to preserve their reputation and the reputation of the family. 
Otherwise she hardly will get marry again and can be victim of honor killing.

Man can live alone without any conditions, but normally they will return to their parents' house. So, his mother will take care of his clothes, food, cleaning.



Children Custody
The father is the legal guardian of the children, but the mother will have the custody if the children are underage until they reach the 15 or 18 years old.  
If the mother remarries, she will lose the custody for her ex- husband. That doesn't happen to the father. 

For foreign non-muslim mothers the children custody is till 7 years old.



According to the Jordan's Departments of Statistics, the country registered its record of divorces, in 2016.

Some of the most common reasons presented were: financial problems, physical and verbal abuse, extramarital affairs, family members meddling in the couple's lives and incompatibility, 




Widowhood

For Woman
When a woman gets widow, she will receive the same amount agreed for divorce from the inheritance and will keep the custody of her children.

Traditionally, the older brother should marry her, regardless if he is already married or not.


Nowadays, the widow will stay with her parents, or in her elder son house, or in her older brother house to preserve her reputation and the family's. 
However, the older brother of her late husband or his parents should help the widow and the children financially.

After she become widow, she should stay in home for 4 months and 10 days to make sure she is not pregnant, so she can remarry again.


For Man

The widow man should wait 1 month and 10 days before he remarries.


Children Custody
The widow mother will have custody of her children but the paternal grandfather or parental uncle is the legal guardian.

If the widow remarries, the parents of the deceased husband most probably will want to have the children.  
Arabs families prefer the children to stay in the family than with a stranger man.
